Data Centers under Scrutiny in Washington

On February 4, 2025, Washington Governor Bob Ferguson signed Executive Order 25-05, establishing a workgroup to evaluate the multifaceted impacts of data centers within the state. This initiative underscores the state's commitment to balancing technological advancement with environmental sustainability and economic growth.

 

Washington’s Data Center Tax Incentives: A Magnet for Investment

Washington State has implemented significant tax incentives to attract data center investments, particularly in rural areas. The state's sales and use tax exemption allows qualifying data centers to forgo paying sales tax on eligible server equipment and power infrastructure. This exemption has been a pivotal factor in making Washington an appealing location for data center development.

 

As of July 2024, Washington is home to at least 87 data centers, ranking it among the top 10 states in the U.S. for data center presence. This growth is largely attributed to the state's favorable tax policies and access to affordable, renewable energy sources.

 

However, the rapid proliferation of data centers has raised some concerns. The Times and ProPublica reported last year that “data centers have grown into a major consumer of electricity in some of Washington's greenest counties, threatening the region’s ability to meet power demand while phasing out fossil fuels."  Questions have also been voiced regarding the number of jobs created and whether they outweigh the revenue lost by tax exemptions granted to tech firms such as Microsoft.

 

Objectives of the Executive Order

Governor Ferguson's executive order mandates the formation of a diverse workgroup led by the Department of Revenue. This group will include representatives from the Departments of Commerce and Ecology, the Utilities and Transportation Commission, electric utilities, environmental advocacy groups, labor organizations, and industry stakeholders. Their primary objectives are to:

 

  • Assess Economic and Tax Impacts – Analyze how data centers influence state and local tax revenues and their role in job creation, particularly in rural communities.

  • Evaluate Energy Consumption – Examine the substantial electricity usage of data centers and its effects on local power grids, considering the need for increased energy generation, storage, and transmission.

  • Consider Environmental Effects – Investigate the environmental footprint of data centers, including their contributions to carbon emissions and other ecological impacts.

 

The workgroup is tasked with delivering its findings and policy recommendations to the Governor by December 1, 2025.

 

Balancing Growth and Sustainability

This initiative reflects Washington's proactive approach to managing the complexities associated with data center expansion. By comprehensively studying these facilities' economic, energy, and environmental impacts, the state aims to develop policies that foster industry growth while ensuring sustainability and responsible resource management.

 

Governor Ferguson emphasized the importance of this balance, stating, "We must ensure Washington remains a leader in technology and sustainability — these experts will help us do that. This group will help us balance industry growth, tax revenue needs, energy constraints, and sustainability."

 

Looking Ahead

As the workgroup embarks on its mission, stakeholders across Washington anticipate insights that will guide the state's strategy in integrating data centers into its economic and environmental frameworks. The outcomes of this study could serve as a model for other regions grappling with similar challenges, reinforcing Washington's position at the forefront of sustainable technological development.
